Rewards Programme Terms of Participation

§ 1 Operator and scope
(1) The rewards programme is operated by Marlena Agnieszka Grzesiak, Düppelstraße 40, 24105 Kiel, Germany, VAT ID DE316833520, e-mail info@vitadermis.de (hereinafter "VITADERMIS").
(2) These terms govern participation in the VITADERMIS rewards programme (hereinafter the "Programme") in the online store at vitadermis.de including all language versions. The general terms and conditions of VITADERMIS apply in addition.
§ 2 Participation
(1) Consumers who are at least 18 years old and hold a customer account with VITADERMIS are eligible to participate.
(2) Participation begins when a customer account is created or, for existing accounts, with the first sign-in after the Programme is introduced. It is free of charge.
(3) Each person may participate only once. Points accounts are personal and non-transferable.
§ 3 Collecting points
(1) Points are credited for purchases that have been paid in full and shipped and that are assigned to the participant's customer account. When participation begins, paid, shipped and non-refunded orders of the preceding twelve months that are assigned to the same e-mail address are credited retroactively.
(2) The basis of assessment is the net product value of the order: the sum of the product prices after all discounts, excluding VAT and excluding shipping costs. To convert it into points, the net product value in euros is multiplied by the multiplier of the respective tier (§ 4) and rounded down to whole points.
(3) In the Rose Gold tier this equals 1 point per euro of net product value, in the Gold tier 2 points, in the Platinum tier 3 points.
(4) Shipping costs, VAT, the purchase of gift cards and amounts paid with a rewards voucher (§ 6) do not earn points.
(5) Points are credited once the order has been paid in full and shipped in full. The calculation of each credit can be viewed in the customer account.
§ 4 Tiers
(1) The Programme has the tiers Rose Gold, Gold and Platinum. Participation starts in the Rose Gold tier.
(2) The tier is determined by the points credited in the most recent twelve months (§ 3, § 5), less the points reversed in that period (§ 8). Redeemed (§ 6) and expired (§ 7) points are disregarded for this purpose. The Gold tier applies from 1,500 points, the Platinum tier from 3,000 points.
(3) The tier is recalculated continuously. If the total of points collected in the last twelve months falls below a threshold – for instance because older credits leave the period or points are reversed – the correspondingly lower tier applies. Redeeming points does not affect the tier.
(4) The higher multiplier applies to all purchases made after the tier has been reached. The purchase with which the tier is reached is still assessed at the previous tier.
(5) The tier is determined continuously from the points collected in the last twelve months and can be viewed in the customer account at any time.
§ 5 Welcome points
When participation begins, 50 welcome points are credited once. They can be redeemed like collected points, count towards the tier under § 4 and are subject to expiry under § 7.
§ 6 Redeeming points
(1) Points can be converted into a voucher in fixed steps of 100, 200 or 400 points. 100 points correspond to a voucher value of EUR 5.00.
(2) The voucher is issued in the customer account, is personal, can be redeemed only once and is valid for twelve months from issue. It applies to orders with a product value of at least EUR 40.00.
(3) The voucher cannot be combined with other voucher or promotion codes. Only one code can be used per order.
(4) Cash payment, interest or offsetting against outstanding claims is excluded. An issued voucher cannot be converted back into points.
(5) When redeeming, the oldest points are always used first.
(6) Only one unredeemed voucher may exist at any time. A further voucher can be issued only once the previous one has been redeemed or has expired. Only one rewards voucher can be used per order.
§ 7 Expiry of points
(1) Points expire twelve months after the day they were credited unless they have been redeemed by then. VITADERMIS sends a reminder 30 days before expiry by e-mail to the address stored in the customer account.
(2) When the customer account is deleted or participation ends, all unredeemed points expire.
§ 8 Withdrawal, returns and cancellation
(1) If an order is withdrawn, returned or cancelled in whole or in part, the points credited for it are reversed proportionally.
(2) If those points have already been redeemed, the points account may temporarily show a negative balance. Newly collected points are first set off against the negative balance.
(3) The statutory right of withdrawal remains unaffected by these provisions.
§ 9 Misuse, termination and end of the Programme
(1) Participants may end their participation at any time without notice, in particular by deleting their customer account.
(2) VITADERMIS may end participation with immediate effect in the event of breaches of these terms, abusive use (such as multiple accounts or deliberate order-and-return patterns to obtain points) or suspected fraud. Unredeemed points expire in that case.
(3) VITADERMIS may end the Programme with three months' notice. Until the end of that period, collected points can be redeemed under § 6.
§ 10 Changes to these terms
VITADERMIS may change these terms with effect for the future, in particular the point values, tier thresholds, multipliers and redemption rules. Changes are announced by e-mail at least four weeks before they take effect. Points collected until then keep the value applicable at the time they were credited. Participants who do not agree to a change may end their participation under § 9 (1).
§ 11 Data protection
To run the Programme, VITADERMIS processes the data stored in the customer account as well as order and points data. Details, in particular on the legal basis, retention period and service providers used, are set out in the privacy policy.
§ 12 Final provisions
(1) The law of the Federal Republic of Germany applies. Statutory consumer-protection provisions of the state in which the participant has their habitual residence remain unaffected.
(2) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
